March 31, 2012, is an important deadline for a number of facilities that discharge stormwater pursuant to NPDES permits 1200-Z and 1200-COLS issued by the Oregon Department of Environmental Quality (“DEQ”).

For facilities that are subject to the NPDES permit 1200-Z (i.e., facilities that discharge stormwater to waterbodies other than those in the Columbia Slough watershed), March 31 is the date to submit their renewal application and updated stormwater pollution control plans (“SWPCPs”) to DEQ.

For facilities subject to the NPDES permit 1200-COLS (i.e., facilities that discharge stormwater to waterbodies within the Columbia Slough watershed) and that have exceeded the benchmarks based on the fourth year geometric mean evaluation, it is the date to submit updated SWPCPs. These facilities should have already submitted their renewal application to DEQ.

This deadline is a part of the new NPDES permits that DEQ issued in October 2011 and that impose more stringent requirements on stormwater discharges in Oregon. For additional information, contact Hong Huynh at hong.huynh@millernash.com.
